1. The short version
- You must be 18+ to list. You must own the items you list.
- We are a marketplace facilitator — we collect payment on behalf of sellers and pay them out after pickup confirmation. Sellers are responsible for their listings, item condition, and tax obligations.
- We charge an 8% commission on each completed sale.
- Listings must be legal, accurately described, and yours to sell. No firearms, drugs, alcohol, tobacco, hazardous materials, counterfeit goods, or stolen items.
- We can remove listings, suspend, or ban accounts that violate these terms.
- Buyer protection covers misrepresented items reported within 48 hours of pickup. We mediate disputes; final decisions rest with us.
- We're based in Washington State. WA law governs these terms.
2. Eligibility
You must be at least 18 years old and a resident of, or have a verifiable connection to, the Gig Harbor / Pierce County area. You must provide accurate phone and email contact, and verify your phone before listing.
3. Marketplace facilitator status
Gig Harbor Sales operates as a marketplace facilitator under Washington State law (RCW 82.08.0531). We collect payment on behalf of sellers and remit those funds (less commission) after pickup confirmation. Where required by law, we collect and remit applicable sales tax. Sellers are responsible for their own income tax reporting.
4. Listings
You may not list:
- Anything illegal under federal, Washington, or Pierce County law.
- Firearms, ammunition, or weapons (federal/state laws on private firearm sales apply).
- Alcohol, tobacco, vape, cannabis, or controlled substances.
- Prescription medications or medical devices.
- Counterfeit, replica, or stolen goods.
- Live animals or animal products.
- Hazardous materials.
- Adult content or services.
- Anything you do not legally own.
We reserve the right to remove any listing for any reason, including but not limited to listings that violate community standards or our judgment of marketplace integrity.
5. Fees and payouts
We charge sellers an 8% commission on each completed sale. Stripe processing fees (~3%) are paid by buyers as part of secure checkout. Sellers receive 92% of the listed sale price, paid out within 2 business days of pickup confirmation via the seller's selected payout method.
6. Buyer protection
Buyers may report a problem with an item within 48 hours of pickup confirmation. Issues that qualify: significantly not-as-described, non-functioning when claimed functional, or missing parts/components. Issues that don't qualify: buyer's remorse, normal wear, items that perform as represented in the listing.
If we determine a complaint is valid, we will offer the buyer a refund (and recover funds from the seller). All such determinations are at our sole discretion.
7. User conduct
You agree not to: harass other users, share off-platform contact info before pickup is arranged, attempt to circumvent platform fees, list duplicates, or use the platform for any purpose other than legitimate buying and selling.
8. Disputes
Any dispute arising from your use of the service shall be resolved by binding arbitration in Pierce County, Washington, under Washington law. You waive class action rights.
9. Liability
The service is provided "as is." We are not responsible for the accuracy, condition, legality, or quality of items listed. We are not a party to transactions between buyers and sellers, except as marketplace facilitator for payments.
10. Changes
We may update these terms at any time. Material changes will be posted with a new "Last updated" date. Continued use after changes constitutes acceptance.
